The 38-40 is the 41 spec of the old guns . They screwup when they called it a 38-40 it is really a 40-40 . In a modern gun it can be loaded to almost 41 mag spec or if you load it with Black Powder makes it is super accurate round .

Then how come the brass in the 38 40 is different from the 44-40?

The 38-40 [40-40] takes a .400 bullet and the 44-40 take .424 to .429 bullet . You can use the brass from one to make the other one ..

38-40 takes a .400 bullet what size are you trying to make it .... below is 30-40 Krag brass which is .308 and I make into 40-60 Maynard or 40 Krag which is .408 with no problems .

44-40 brass is 10x easier to find then 38-40 and it loads .426 to .430 . I load 44-40 brass at .429 .

I was a gun-cravin' high-schooler when th' 41 was "born" but, if memory serves me correctly, Elmer Keith was involved in the "41 project," but the "police load" didn't prove to be what he and others envisioned. In the late 60's and 70's...even into the early 80's...there were several guys with the Harris County Sheriff's Office carryin' and shootin' the 41. A good friend did some serious work on hijackers with one, and, in a chase that we were in, me drivin' and him shootin', the 41 did a number on the rear tires of the bad guy's car.

Th' "N" frames DID "weight ya' down" tho', and today everybody is tryin' to cut weight on the duty rig any way possible.

I still use n' enjoy th' .41 today...but...it's a Blackhawk instead of a Smith. And...there are some really good buys "out there" on .41 Blackhawks...seems that they don't bring quite what the .357's and .44's do, especially used ones. When I bought mine several years ago, new, at a show, it was $20 bucks cheaper than the other calibers. Oh darn!!!!!
