Which is best? New Ruger American in 270 no scope for $299.99 +tax and background check or a used Marlin XL7 270 with Nikon prosatff scope and 100 rounds of ammo for $350 out the door? Any help is greatly appreciated.

The prostaff is their lower tier scope so for me personally it doesn't factor in as I'd replace it. Is the ammo factory ammo or reloads? Has the gun proven to like the ammo? Don't think the guns are very different quality wise, if the used marlin isn't an abused marlin. Will the marlin be papered, federal form? If yes I think my decision would be based on which one feels right when I shoulder it. If no, I'd lean toward the marlin.

Yeah the marlin is through a second party so no papers. Just straight out.

My thought is you are paying new price for a used Marlin. I would go with the Ruger. I never think about sales tax as NH doesn't have either sales or income taxes. As far as background check cost find a dealer that doesn't charge for that.

I'd go Ruger. New gun with Ruger's basically lifetime warranty and their usually great Customer Service. You get zip with the Marlin, if it has a problem you're on your own.
